CITY OF MILFORD JUNE 7, 2022 The following is a condensed form of minutes: A complete copy is on file at the Milford City Hall, 402 1st St., Milford, NE, or on the city’s website: milfordne.gov The Mayor and Council met in regular session on June 7, 2022, at 7:00 pm. Mayor Kelley called the meeting to order at 7:00 pm. Present: DeLong, Freeman, Keib, Roth. Nebraska Open Meetings Act requirement met. APPROVE AGENDA AS SUBMITTED: Approved the agenda as submitted. CONSENT AGENDA: Mayor Kelley read the Consent Agenda: a. Approve Minutes: 5/3/22 and 5/24/22 b. Approval of Claims: Totaling $293,927.59 c. Approve Treasurer’s Report for April 2022 d. Authorize sale of Fireworks to Clouse Bros LLC @ 115 S. Hwy 6. e. Approve Fire Station Rental Use Agreement and Cleaning Procedures. f. Appointment – Cemetery Board – Jim Eberly g. Authorize payment process of drawdown #2b for the DTR Planning Project in the amount of $16,763.30. SALARIES: $73,706.92 GENERAL FUND: (See attached) PRESENTATION: Downtown Revitalization Planning – Caitlin Bolte and Rachel Anderson, Confluence. Caitlin and Rachel presented the information gathered from the 6 month planning sessions of the DTR Advisory Committee and the publics input. This plan will set Milford up to proceed into phase II which is implementation. The DTR Planning draft is available at the City Office. Kelechi Chibuikem with SENDD shared that this lays the groundwork to secure funds. The city will need to discuss necessary gap funding as the CDBG grant maxes out at $400,000.00. We will need to work together to explore funding opportunities. Gerry Dunlap mentioned the Confluence team did an excellent job of listening to the group and coming back with ideas. It was a well thought out team effort. Gerry would like to speak in favor of moving forward with the revitalization of the downtown project. Milford has been stagnant for years. PUBLIC HEARINGS: To hear testimony in favor of, or opposition to, and to answer questions in relation to a proposed Conditional Use Permit located at Lot2, TeSelle Addition. NW corner of West Milford Rd. and North Welch Park Rd. to place a hub station on the property for ALLO Fiber. Mayor Kelley opened the public hearing at 7:49 pm. Mayor Kelley: Allo is needing a space and we are excited they are coming to town to build fiber, TV and phone. They are looking for a space to place a building to operate out of. The internet/ fiber comes from the N.W. corner of town as other companies are pulling fiber from this area. Allo had asked for space at Welch Park, but that option was not available. Mayor Kelley asked Gary where we might go with the building. Gary’s family happens to own land directly north of Welch Park. This proposal was presented to the Planning Commission and there were questions concerning zoning from 3 to 5 acres and they denied the request. Mayor Kelley stated he wished they wouldn’t have made a motion to deny it rather than continue to explore some further information before making that kind of decision. It is maybe sending a message to Allo that we are not interested in having them in our community, but more so we just need to find a suitable place for the building. He will be reaching out to Allo to share our desire to have them in the community. Gerry Dunlap – spoke in favor of bringing Allo to the community and doing everything possible to get them here. The land in question is a narrow piece of ground with limited use and he thought it was a good use of the property. Jonathan Jank, SCCDP: Fiber to the home has been a priority in Seward County for quite some time. Clearly this is a great generational opportunity for Milford to pursue it. Allo’s reputation proceeds them, and he appreciates the TeSelle’s being open to this because the fiber hub in needed. Mayor Kelley understands where the Planning Commission is coming from but asked about a way to approve this without changing the property out of TA. Attorney Aerts stated you have a consideration item; the city council can reject the recommendation. We are excited to have Allo in town and we have the landowners that are allowing this to be present. It may not be the ideal location but it’s kind of like TIF “but for”. There’s no other location for the building. With no further comments Mayor Kelley closed the public hearing at 8:06 pm. UNFINISHED BUSINESS: Consider request from Jonathan Conley seeking exception to City Ordinance Chapter 6, Article 1, Section 22 for a 13-year-old emotional support/assistive dog. Jonathan Conley shared that as of Sunday he relocated his dog to a temporary foster home. He shared the information on his home insurance policy which the council had asked for. He has a meeting with the Greater Lincoln Obedience School for an evaluation of his dog. He is looking into the K-9 Good Citizen testing and a temperament test. He is waiting for a quote from Home Depot to update his fence. Freeman asked, if the dog has training for an emotional support dog or just obedience training? Conley stated, there is no emotional support training. Roth asked about training in Des Moines? Conley said no, he is going for an evaluation at the Greater Lincoln Obedience Club and because Queenie is not a puppy there are several levels of training. The evaluation on Monday will determine whether she goes to the level one class or the level two class. Des Moines, IA is the closest he could find for a temperament test. Roth asked if we waited for the temperament test results and then decided, would he be in favor of that? Conley, honestly did not like being away from my dog but if that is the Council’s wishes. Conley is not here to change the ordinance in Milford. He is just asking to keep his dog for the last 2+ years of her life. He asked if he were to do the obedience test, temperament test, get the K-9 Good Citizen Certification and clarifying with USAA would the Council grant the exception? If there is no payment plan with Home Depot that is $10,000.00 and it would take him 2 years to save up that much money. If the Council can’t give me a guarantee that if he does X, Y and Z then he will not be staying in Milford, which is not a threat, he just does not want to be away from his dog. He does not want to throw $10,000.00 into a property fence for a maybe, this is not something he will do. Mayor Kelley is recommending not moving forward but continue gaining information. Consensus was to continue this item to a future meeting. CURRENT BUSINESS: Items approved: a. The Conditional Use Permit submitted by Allo for the use of TeSelle’s land at the NW corner of West Milford Rd. and Welch Park Rd for the Allo hub station going against the recommendation of the Planning Commission to deny the request. b. The Downtown Revitalization Plan as presented. c. The proposal from Schumacher Elevator Company in the amount of $3,962.00 for the repair and annual testing on the lift at the Sr. Center using the funds that had originally been earmarked for JEO with respect to this project. d. The service agreement with Schumacher Elevator Company for preventative maintenance of the lift at the Sr. Center at $115.00 per month. e. The E911 budget for 2022-2023 fiscal year as presented. f. Approve the healthcare insurance cost for the Chief of Police subject to final approval of legal counsel. Items of no action: a. Schedule Work Session to determine focus/priorities of DTR grant application. b. Set date for budget work night. c. Barry Erb request for modification of golf cart laws. RESOLUTIONS: Resolution No. 640 – William Webermeier Scholarship Fund Resolution – indicating representative appointed to be duly authorized secretary of the committee to record meeting minutes.
