PUBLIC NOTICE To Seward County Landowners and Tenants: Neb. Rev. Stat 39-301 provides in part that “any person who injures or obstructs a public road by placing or leaving any other obstruction thereon, by encroaching upon the same with any fence, shall upon conviction thereof, be guilty of a Class V misdemeanor and in case of placing any obstruction on the road, be charged an additional sum… to remove the same by the road overseer or other officer in charge of road work in the area where such obstruction is located.” The County may “recover the necessary cost of such removal from such owner or other person obstructing such road.” Having fences installed and the planting of crops along county road shoulders and in road ditches can have serious consequences for the safety of those traveling county roads, as well as making the maintenance of county roads by road employees more difficult. The Seward County Board of Commissioners and Highway Superintendent request that all fences that are presently along the shoulder of the road or in the road ditches be removed and that all fences and the planting of crops be set back from the center of the county road a minimum of thirty-three (33) feet. Any fence or planted crops remaining in the county road right-of-way will be considered an obstruction and Seward County or any Seward County road employee cannot and will not be held responsible for any damage to fences or crops within the county road right-of-way during the performance of their duty. Your cooperation in this matter is appreciated. Please help keep Seward County roads safe for all those who travel them, by keeping fences and planted crops out of the County road right-of-way.
